Jet Drain:
The council discussed line item estimates for tile improvements that were presented by Jesse Berstler from Jet Drain.  Due to the delay in receiving quotes for the street repairs, the Jet Drain work will be discussed at a later meeting.

New Business:

Amendment to June 18th Special Event:
Whatcha Smokin’ BBQ and Brew submitted a request to amend the times for the currently approved special use permit for June 18th from 5-7 pm to 6-8 pm.

Motion by Councilperson Isabell, seconded by Councilperson Owens, to approve the time change from 5-7 pm to 6-8 pm for the June 18th bike night.

Liquor License Request for Outside Sales:
Tanya Doyle from Whatcha Smokin submitted a request for a change in their current liquor license to include outdoor sales.  Currently the license allows, customers waiting for a table to take beer and wine coolers outside on the patio but mix drinks are prohibited .  Treasurer Sprouse shared her research from the State Alcoholic Beverages Division (ABD) regarding the requirements in the contained area. ABD is the State entity that oversees liquor sales, licenses and enforcement in Iowa.  Under the current Iowa Code, A “beer class” products are allowed outside of the building it is served from on private commercial property if the premises has a beer license or above., however, an endorsement for outdoor sales is required for alcoholic beverages outside of the “beer class”.  The outdoor sales endorsement requires a map to be provided of the outdoor area where patrons will be allowed to consume alcohol that will now be included under the permit and dram shop insurance. Approval of this endorsement will allow all drinks to be consumed in the outdoor area that is used by customers who are waiting for a table.  By City Code, any actual sale of alcohol outside will still require a special event permit.

Motion by Councilperson Owens, seconded by Sandegren, for the City of Luther to grant permission to LLC Investments (Whatcha Smokin’) to have outdoor seating for overflow customers to consume alcoholic beverages by approving the outdoor license with the Alcoholic Beverage Division.  All outside sales will continue to be covered by the special use permit as now addressed in our ordinances and will require a special events permit for all outdoor activities.

Special Event Applications:
Whatcha Smoking submitted additional applications to hold bike nights from 6-8 pm on the first and third Tuesday of July and August and asked for a waiver to the 60 day event notice.

Motion by Councilperson Sandegren, seconded by Councilperson Isabell, to approve the 60 day waiver request and approve the special events for the  first and third Tuesdays of July and August as submitted.

Mosquito Spraying:
Clerk Sandegren stated the city was sprayed on June 4th.  The council had a short discussion on having Mosquito Control of Iowa spray three to four times a month for fewer months versus one to two times for several months.  Sandegren will contact Mosquito Control of Iowa to share this thought.

National Flood Insurance Program:
Treasurer Sprouse discussed the information sent to the city regarding flood insurance as it relates to the City, FEMA funds and residents.  FEMA has been updating floodplain maps in the State for over 10 years. Participation in the program is voluntary, however, if the City chooses not to participate residents will not be able to obtain flood insurance through the program and the City will not be eligible to apply for FEMA disaster funds should the need arise.    Participation in the program does not force anyone to participate, nor does it impact the area designed as being prone to flooding on the FEMA Map. There is no cost to the city to join this program. Very little land within Luther CIty limits is marked on the FEMA map as being an area prone to flooding and no houses or structures are within that area.

City Credit Card:

Clerk Sandegren asked the city to consider acquiring a city credit card due to new criteria when  purchasing a visa gift card. Treasurer Sprouse added the auditors prefer cities to use credit cards.

Motion by Councilperson Isabell, seconded by Councilperson Owens, to approve a city credit card at the minimum amount to be used to purchase city expenditures in order to conduct city business.

City Staff Updates:

Mayor Krohn will visit with Black Top Services for an update on quotes on street repairs due to the frost boils.  A work session may be needed to discuss street repairs and continued tile work.

Clerk Sandegren stated she will be on vacation June 28-July 9 and asked if someone could help assist with the hall rentals during that time.  Mayor Krohn and Treasurer Sprouse volunteered to help.

Clerk Sandegren shared the Boone County Landfill will be closed beginning at 11:00 am on Friday, June 28th through Saturday, June 29th in order to install a new scale.  Sandegren will post a message in the kiosks.

Old Business:

Street Repairs:
Frost boils erupted on several streets due to the extreme weather this past winter, however the rock fill where the street were cut for the installation of the storm tile stood up well to the weather and snow removal.  Blacktop Services has been contacted for an estimate on repairing the boils. If not repaired, the street will peel back from the boils and create a larger issue. The city is seeking an inexpensive, temporary repair to keep streets passable since a project to resurface all city streets is coming up in the long range plan.  

New Business:

Amendments to Special Events:
Whatcha Smokin’ BBQ and Brew submitted a request to amend the currently approved special use permits to include the sale of sandwiches at outdoor kiosk(s) similar to what was set up for RAGBRAI last summer.  This will alleviate the concern that the indoor order station will become overwhelmed and over-crowded.

Motion by Councilperson Johnson, seconded by Councilperson Wilczak, to amend the special use permits to allow the pre-wrapped sandwiches/food and non-alcoholic drinks outside of the main building.  Current dates for the special use permits are May 21, June 4 and June 18.

Liquor License Approval:
Whatcha Smokin’ BBQ and Brew submitted their request to renew their annual liquor license which is due to expire on June 11th.  The business has had no violations during the past year. The renewal submitted is slightly different than the license last year due to a glitch in the Iowa Alcoholic Beverages Division (ABD) software.  It automatically included the additional permissions that were granted only for RAGBRAI last summer. If Whatcha Smokin’ wishes to permanently add the additional permissions, a request may be submitted through the ABD website at any time and items required by Iowa Code submitted to the City Council for review and consideration at a future council meeting.  

Motion by Councilperson Owens, seconded by Johnson, to approve the renewal of the same level of  liquor license as approved last year for Whatcha Smokin’ BBQ and Brew (without outdoor service).

The renewal of the liquor license prompted a question about where patrons are allowed to go with alcoholic beverages during special events, specifically, are patrons allowed to wander the property and look at vehicles while carrying an alcoholic beverage.  The liquor laws are regulated by the State and the City does not have the authority to make those laws less restrictive. The City will contact ABD and get a definitive answer regarding what is allowed before the upcoming event on May 21st. However, until ABD clarifies what is allowed, the City Council recommends erring on the side of caution and not allowing patrons to leave the building carrying an open alcoholic beverage.  

Building Permit:
A building permit was submitted to the council requesting a deck on the front of the property at 211 Iowa Ave.

Open Forum:  

There are four properties in town that have grass/yards in need of mowing. The City Clerk will send notices to the property owners and follow-up as directed by City Code.

City Staff Updates:

The City Council had previously offered a resident help with removing a tree that fell on his home.  The home owner would like to accept this assistance and get the tree removed from his property. Mayor Krohn will coordinate a time.

The City Council would like to extend a big thank you to Mark Roberts for repairing a building that had been damaged during the tile installation.   

Councilperson Johnson moved to adjourn at 7:37 PM.  Councilperson Owens seconded.

Special Use Permit Amendment – Luther Investments:
Ron Lappe was in attendance asking for an amendment to the special use permit. Instead of installing slats on the existing chain link fence, a 6’ privacy fence will replace the chain link. Mr. Lappe asked about the timeline and the Council stated it would need to be completed by the original time frame.
Motion by Councilperson Isabell, seconded by Councilperson Owens, to approve the amendment to the special use permit to replace the slat requirement with a 6’ privacy fence.

Special Event Applications-Whatcha Smokin:
The council reviewed two special event permit applications submitted by Whatcha Smokin’ BBQ & Brew. The events will be held on Tuesdays from 5 to 7 PM and there will be live acoustic music.
Motion by Councilperson Sandegren, seconded by Councilperson Isabell, to approve the special event permits for Tuesday, June 4th, 2019 and Tuesday June 18th, 2019 as detailed on the permit.

Street Repairs/Patching:
Mayor Krohn shared with the Council concerns of frost boils popping up at two locations in town. These will require more immediate attention and his recommendation is to amend the current work order with the street contractor.
Motion by Councilperson Owens, seconded by Councilperson Sandegren, to approve the change in the existing work order from doing all of the tile cutouts right now to doing only the tile cut out on Luther Street near the city hall and the frost boils areas at Worth & Bennett, 3rd & Worth street.

Another work session was held on March 26, 2019 at 7:00 pm with Council Members, Jeff Sandegren, Maggie Wilczak, Gus Johnson, City Clerk Deanna Sandegren, and City Treasurer Mary Beth Sprouse present. Council members Robbie Isabell and Bob Owens and Mayor Krohn were absent

The Council continued the process of reviewing the ordinances to prepare for the upcoming codification, reviewing wording, typos, and recommendation topics from the Iowa Codification Company to include current Iowa Codes.

The work session adjourned at 9:00 p.m.

Public Hearing for Budget FY20:
Mayor Pro Tem opened the public hearing at 7:13 PM. No written correspondence was received by the Clerk’s office regarding the proposed FY 20 budget. Councilperson Wilczak arrived at 7:15 PM. With no comments being heard, Mayor Pro Tem Sandegren closed the public hearing at 7:16 PM.

Motion by Councilperson Owens, seconded by Councilperson Wilczak, to adopt Resolution 031219 and approve the Budget for FY20 as presented.

New Business:

Boone Fire Department:
Justin Adams, the Boone Fire Chief, came to update the council on services provided by the Boone Fire Department for the City of Luther. The City contracts with the City of Boone for fire protection which costs roughly $2500 per year. While the Boone Department is Luther’s primary fire agency, the Boone Fire Department has 28E agreements with all of the other surrounding departments as well. Under these agreements, the departments share services and help each other out on calls. A call in the City of Luther may bring responders and vehicles from Boone, Slater, Madrid, Woodward, Westory Fire Agency and Gilbert. This is critical when it comes to fire suppression. The city’s water supply through the fire hydrants is inadequate to fight any type of major structure fire. Instead, water is brought to the city in trucks, dumped into a “porta-tank” and then drafted from the tank by an engine to provide good pressure for the hoses. A fully involved structure fire may need 3 to 5 trucks bringing water to keep the engine supplied. Water is refilled at the Xenia tower just East of town as well as in Slater, Madrid and Kelley. The Boone Fire Department has a staff of 9 full time, 7 part time and 20 paid on call members. There are always 3 members at the station and more are called in when they are sent out. The Boone Department also has 5 fire engines and 9 other emergency response vehicles.

Special Event Applications:
The council reviewed several special event permit applications submitted by Whatcha Smokin’ BBQ & Brew. The events will be held on Tuesdays from 5 to 7 PM and there will be live acoustic music.
Motion by Councilperson Owens, seconded by Councilperson Isabell, to approve the special event permits for Tuesday, May 7th and Tuesday May 21st as detailed on the permit.

Nuisance Abatement:
A resident came to address the council in regards to a property that has repeatedly violated the nuisance section of the City Code. The resident expressed his wishes that the property could be better maintained and not be allowed to get as bad as it has been before some kind of clean-up is initiated. The council informed him that they are certainly aware of the property and are currently working through the abatement steps at the property. The council may be able to impose a daily fine on the property for repeat offenses and can assess those fines on the property taxes for collection

Mowing 2019 Season:
The council discussed the mowing options for the 2019 season. Blades has done the City mowing for the past 2 seasons and has a contract with the City to place grass seed later in the spring. There may have been a communication issue last season that lead to the some untimely mowing and extra charges for grass clipping sweeping. Other than that issue, the City has been pleased with their performance. Blades offers to extend their previous contract into the 2019 season with no change in rates. Councilperson Johnson moved and Wilczak seconded, to approve the 2019 contract with Blades with the requirement that they mow City property once every 5-15 days as needed and if sweeping is needed due to the company delaying mowing, it be done at no charge.

Open Forum

Councilperson Owens wanted to thank Kempton Young from the Co-Op for all of his help in clearing snow from the street corners when the piles began to melt so that runoff could flow.

Emergency Management:
The Emergency Management Director for Boone County has retired and applications are being accepted until April 1st for his replacement. Emergency Management is funded through the County Board of Supervisors, however, if they are not able to meet the budget needs of the department the Cities may be asked to use their Local Emergency Management levy to cover the shortfall
